These Terms of Service govern your use of the DreamStream mobile application (the "App") and the website https://dreamstream.art (the "Website"), together the "Services". By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility & Account

• You must be at least 13 years old (or the minimum age required in your jurisdiction, which may be 16 in some regions) to use the Services.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate, complete, and current information when creating or updating your account.

3. License & Acceptable Use

DreamStream grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes. You agree not to misuse the Services or help others do so.

• Do not violate laws, regulations, or third-party rights.
• Do not attempt to reverse engineer, decompile, or bypass security features.
• Do not scrape, harvest, or collect data without authorization.
• Do not upload malicious code, interfere with service availability, or attempt unauthorized access.
• Do not use the Services to harass, harm, or exploit others.

4. User Content & Permissions

You retain ownership of the content you submit, such as dream entries, audio, images, and preferences. You grant DreamStream a non-exclusive, worldwide, royalty-free license to host, store, process, and display your content solely to operate, provide, maintain, and improve the Services, including generating AI outputs you request.

You represent that you have the rights to submit your content and that it does not violate any law or third-party rights. We may remove or restrict content that violates these Terms or poses a safety risk.

DreamStream is private by default. We do not operate a public feed or directory of your content. Any sharing or exporting is initiated by you, and you are responsible for what you share. If we add new in-app sharing experiences later, we will provide notice and update these Terms as needed before launch.

5. AI Features & Health Disclaimer

DreamStream uses automated systems to generate interpretations, summaries, and visuals for general wellness, journaling, and self-reflection. AI outputs may be inaccurate, incomplete, or inappropriate for your situation and should not be relied on as a source of truth.

DreamStream is not a medical device and does not diagnose, treat, cure, or prevent any condition. DreamStream does not provide medical, psychological, or therapeutic advice. If you need medical or mental health support, contact a qualified professional. If you are experiencing an emergency, contact local emergency services immediately (United States: call 911; mental health crisis support: call or text 988).

6. Subscriptions, Trials, and Billing

• Subscriptions are billed through the App Store or Google Play and auto-renew unless canceled at least 24 hours before the end of the current period.
• Manage or cancel subscriptions in your store account settings. We do not store payment card details.
• Free trials, if offered, convert to a paid subscription unless canceled before the trial ends.
• Prices, taxes, and renewal terms may change with advance notice as required by law.
• Refunds are governed by the applicable app store policies unless required by law.

7. Third-Party Services

The Services rely on third-party providers for analytics, notifications, cloud hosting, and AI processing. Their terms and policies may apply to your use. We are not responsible for third-party services or content accessed through links in the App.

8. Availability and Updates

We may modify, suspend, or discontinue any part of the Services at any time. The Services may be unavailable due to maintenance, outages, or updates.

Features and content may evolve over time as we improve quality, reliability, and safety.

9. Intellectual Property

DreamStream and its licensors own all rights, title, and interest in the Services, including software, design, and trademarks. You may not use our branding without prior written permission.

You may stop using the Services at any time and cancel subscriptions through your app store settings. We may suspend or terminate access if you violate these Terms or if required for safety, security, or legal reasons.

11. Disclaimers

The Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. We do not guarantee that the Services will be uninterrupted, error-free, or secure, or that AI-generated content will be accurate.

12. Limitation of Liability

To the maximum extent permitted by law, DreamStream and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue arising from your use of the Services.

13. Indemnification

You agree to indemnify and hold harmless DreamStream and its affiliates from any claims, liabilities, damages, and expenses arising out of your use of the Services or violation of these Terms.

14. Governing Law

These Terms are governed by the laws of Delaware, United States, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Delaware unless local law requires otherwise.

We may update these Terms from time to time. If we make material changes, we will notify you via the App or email. Continued use of the Services after updates constitutes acceptance of the revised Terms.
